Child Abuse in Florida — Legal Consequences and How to Defend Yourself

Being accused of child abuse is one of the most serious and emotionally charged allegations in the Florida legal system. Even before a conviction, this type of charge can damage reputations, careers, and relationships. If you or someone you love is facing child abuse charges, you must act fast—and wisely.

At Bozanic Law, we understand the weight these accusations carry. We’re here to protect your rights, tell your side of the story, and make sure one accusation doesn’t destroy your future.

What Is Considered Child Abuse Under Florida Law?

According to Florida Statute § 827.03, child abuse is defined as:

  • Intentional infliction of physical or mental injury upon a child,
  • An intentional act that could reasonably be expected to cause injury, or
  • Active encouragement of any person to commit such acts against a child.

Importantly, a person can be charged even if the child didn’t suffer visible injuries. Mental or emotional harm, or the risk of harm, may still qualify as child abuse under Florida law.

Types of child abuse charges include:

  • Child Abuse (without great bodily harm)
  • Aggravated Child Abuse (involving torture, malicious punishment, or serious injury)
  • Child Neglect (failing to provide care, supervision, or services)

What Are the Penalties for Child Abuse in Florida?

Penalties vary based on the severity of the accusations:

  • Child Abuse (No Great Bodily Harm):
    Third-degree felony
Up to 5 years in prison and/or $5,000 in fines
  • Aggravated Child Abuse:
    First-degree felony
Up to 30 years in prison and/or $10,000 in fines
  • Child Neglect with No Injury:
    Third-degree felony
Up to 5 years in prison
  • Child Neglect with Injury:
    Second-degree felony
Up to 15 years in prison

In addition to jail time, a conviction can lead to:

  • Loss of child custody or visitation rights
  • Mandatory parenting classes or anger management
  • Placement on child abuse registries
  • Damaged professional licenses or background checks
  • Lifetime stigma in your personal and professional life

What Happens When You’re Accused?

Florida law mandates that anyone who suspects child abuse must report it. Once a report is made—whether to a school, doctor, neighbor, or the Department of Children and Families (DCF)—the case is investigated quickly.

You could face:

  • Criminal charges from law enforcement
  • Administrative action from DCF, including removal of children from the home
  • Court-ordered evaluations, supervised visits, or no-contact orders
  • Public records exposure that can affect employment, custody, and housing

It is crucial that you do not speak to investigators or DCF agents without an attorney. Even innocent explanations can be twisted into evidence against you.

How Can You Defend Against Child Abuse Charges?

Defending against child abuse allegations requires experience, sensitivity, and aggressive legal strategy. At Bozanic Law, we examine every detail of your case to challenge assumptions and expose false accusations.

Common defenses include:

  • False or exaggerated allegations (often in divorce or custody disputes)
  • Accidental injury with no intent to harm
  • Lack of evidence or conflicting medical opinions
  • Mistaken identity or incorrect witness reports
  • Disciplinary action misunderstood as abuse

We also coordinate expert testimony, psychological evaluations, and witness statements when needed. Our goal is to fight for your freedom and protect your reputation.

What Should You Do If Accused of Child Abuse?

  • Do not speak to law enforcement or DCF without an attorney.
  • Document everything. Keep records, messages, and witnesses who can support your version of events.
  • Avoid contact with the accuser or child (unless authorized).
  • Retain experienced legal counsel immediately.
  • Stay off social media. Anything you post can and will be used against you.
