Battery in Florida — What the Law Says and How to Protect Yourself

Being arrested for battery in Florida is serious. Whether it happened during an argument, in public, or was the result of a misunderstanding, the consequences of a battery charge can be life-changing. From jail time to a permanent criminal record, your future is on the line.

At Bozanic Law, we understand that there are always two sides to every story. If you’ve been accused of battery, we’re here to listen, defend, and fight for your rights with everything the law allows.

What Is Battery Under Florida Law?

According to Florida Statute § 784.03, battery occurs when a person:

  • Actually and intentionally touches or strikes another person against their will, or
  • Intentionally causes bodily harm to another person

Battery does not require visible injury. Even a shove, slap, or unwanted grab can result in a charge if the other person claims the contact was intentional and non-consensual.

Types of Battery Charges in Florida

Battery charges vary depending on the severity of the contact, the victim involved, and whether there are prior convictions.

Simple Battery (Misdemeanor)

  • First offense
  • Unwanted touching or minor physical harm
  • Penalty: Up to 1 year in jail and/or $1,000 fine

Felony Battery

  • Battery with serious bodily harm or prior battery conviction
  • Penalty: Up to 5 years in prison and/or $5,000 fine

Aggravated Battery

  • Battery causing great bodily harm, using a deadly weapon, or against a pregnant person
  • Penalty: Up to 15 years in prison and/or $10,000 fine
  • Often charged as a second-degree felony

Battery on a Law Enforcement Officer or Public Official

  • Carries enhanced penalties and mandatory minimums
  • Applies even if the officer was off-duty in some cases

Can You Be Arrested Without Injuring Someone?

Yes. Florida’s battery laws focus on intentional contact, not just injury. That means:

  • Pushing someone during a disagreement
  • Spitting on someone
  • Throwing a drink in someone’s face
  • Grabbing someone’s arm during an argument

Any of these actions could result in a battery charge—even if the physical harm was minor or nonexistent.

Common Defenses to Battery Charges

At Bozanic Law, we investigate every case closely. Just because someone made an accusation doesn’t mean they’re telling the whole truth. Common defenses we may use include:

  • Self-defense or defense of others
  • Lack of intent — the contact was accidental or misinterpreted
  • Mutual combat — both parties willingly engaged in a fight
  • False accusations — often during emotionally charged disputes
  • Stand Your Ground — in some situations, you may have had a right to defend yourself

Our goal is to get your charges dropped, dismissed, or reduced through strong negotiation or courtroom defense.

What to Do If You’re Charged with Battery

  1. Do not contact the alleged victim, even if you want to explain or apologize
  2. Do not post about the incident on social media
  3. Do not talk to police or prosecutors without an attorney present
  4. Gather witnesses, texts, or videos that could support your version of events
  5. Call a criminal defense attorney immediately

A battery charge can affect your career, relationships, and freedom. The faster we start your defense, the better your chances.
